1. Purpose and scope

Kallea Property Group Pty Ltd (ABN 76 166 118 136) operates Kallea Property Advisors.

Kallea Property Advisors provides commercial property acquisition advisory and continues to support residential investment clients. Public website articles, guides, examples and other resources are intended to explain property concepts and help readers identify issues to investigate.

Public educational material is different from advice and work provided to a particular client under an agreed engagement. An engagement’s scope, responsibilities and limitations should be read in the applicable client documents. This website disclaimer does not replace or change those agreed terms.

2. General information and individual circumstances

Website material does not take account of every reader’s objectives, financial circumstances, business requirements, tax position, ownership arrangements or risk tolerance. A property, structure or strategy described on the website may not be suitable for you.

Use the material as a starting point for questions and further investigation, not as a substitute for reviewing your circumstances, the actual property and the documents for a proposed transaction.

References to possible benefits, risks or common lending arrangements describe matters in general. They are not a recommendation to acquire a particular property, choose a particular structure or proceed with a transaction.

3. Kallea’s acquisition role and specialist advice

Kallea’s commercial acquisition work can include developing an investment strategy and brief, researching markets and sourcing opportunities, evaluating commercial fundamentals, negotiating acquisitions, coordinating specialist due diligence and supporting the transaction through settlement. Brisbane and the Gold Coast are its primary commercial acquisition markets.

Property acquisition advisory does not replace the separate work of appropriately qualified solicitors, accountants, finance brokers, valuers and, where relevant, licensed financial advisers or SMSF specialists.

Public website content is not personal legal, tax, accounting, credit, financial-product or superannuation advice. Obtain advice from the appropriate professional on matters such as contract terms, lease interpretation, borrowing capacity, lending terms, GST, land tax, ownership structures and retirement arrangements.

For an SMSF acquisition, the suitability of an SMSF, fund compliance, trustee obligations, business real property requirements, related-party dealings, financing structure and tax consequences require specialist assessment. Property sourcing does not determine those questions.

4. Residential and commercial property risks

Property investment involves risk. Prices and rental income can fall as well as rise; property may be difficult to sell; vacancies, tenant defaults, unexpected repairs, insurance costs, interest rates and regulatory changes can affect outcomes.

Commercial property may involve additional risks associated with the tenant’s business, lease expiry, incentives, vacancy periods, reletting costs, permitted use, building condition and changes in market demand. A long lease or quoted yield does not guarantee income, tenant performance or resale value.

Borrowing can increase both exposure to losses and ongoing cash-flow commitments. A quoted deposit or LVR is not a lending approval. Actual finance depends on the lender’s assessment, valuation, conditions and the borrower’s circumstances.

No website statement guarantees capital growth, rental returns, borrowing approval, a particular acquisition outcome or the availability of a suitable property.

5. Property information, leases and due diligence

Descriptions of tenants, leases, rents, outgoings, yields and valuations depend on the source information, assumptions and date involved. A net or gross lease label does not establish which costs can legally be recovered or the income ultimately available to an owner.

Asking prices, advertised rents, vendor information and estimated values are not substitutes for examining the actual transaction. Figures may exclude vacancy, incentives, non-recoverable outgoings, capital expenditure, transaction costs, financing and tax unless expressly stated.

Due diligence should address the particular asset and transaction. Depending on the circumstances, this may require review of the lease and title, tenant and payment history, permitted use, planning, building condition, environmental issues, expenses, finance and independent valuation. Coordination by Kallea does not turn another professional’s opinion into a guarantee or replace that professional’s responsibility.

6. Case studies and historical outcomes

Case studies describe particular clients and circumstances. They are not promises that another client will obtain a similar result and should not be taken as representative of every engagement.

Purchase prices, estimates of later value, rental figures and timing must be read with the dates and sources stated. An estimated increase in property value is not necessarily a realised sale profit or a net investment return. It may exclude acquisition and disposal costs, interest, ownership costs, tax and other contributions.

Equity used towards a purchase is not necessarily the total cost or capital required. A historical result does not establish what a property will achieve in the future.

Where a figure’s valuation date, source or assumptions are not stated, ask for that context before relying on it.

7. Calculations and estimates

Worked examples and educational calculations depend on their inputs and assumptions. Rounding, changes in rates and costs, incomplete information and differences between examples and actual transactions can materially affect the result.

A calculation is not a valuation, finance approval, tax assessment or personalised investment recommendation. Read calculations with their stated assumptions, inclusions, exclusions and limitations.

8. Dates, changes and external sources

Laws, lender policies, market conditions and source material can change. Check a resource’s publication and update dates, and confirm that information remains relevant to the proposed transaction. A content update date is not a guarantee that every cited law, figure or external source has been independently rechecked.

External sources and links are provided for context and further reading. Their inclusion does not mean Kallea controls the material, guarantees its completeness or endorses every statement made by its publisher. Third-party websites have their own terms and privacy practices.

Tell Kallea if you identify an error or outdated statement so it can be reviewed. Where specialist interpretation is needed, obtain advice rather than relying only on a summary.

9. Intellectual property and permitted use

Website text, design, photographs, video and other materials may be owned by Kallea or used with permission. Rights in third-party material remain with the relevant owner.

You may view the website and use its general information for your own lawful purposes. Reproduction or commercial reuse beyond what the law permits may require the relevant rights holder’s permission. This does not restrict rights or exceptions available under Australian law.

Do not use the website to interfere with its operation, submit harmful material, impersonate another person or provide personal information you are not authorised to provide. No transfer of ownership in website materials is implied by access.

10. Availability, reliance and legal rights

We aim to present useful, accurate information, but errors, interruptions and outdated material can occur. Decisions should be based on appropriate investigation and advice rather than solely on public website content.

Nothing in this disclaimer excludes, restricts or modifies rights, consumer guarantees or remedies that cannot lawfully be excluded under the Australian Consumer Law or other applicable Australian law.

Responsibility for loss and any permissible limitation of liability depend on applicable law and, where relevant, the agreed client terms. This disclaimer does not override those legal rights or an existing engagement.

11. Questions and updates

Use the website’s contact or strategy-call channel for questions about a resource or the property acquisition services described. A website enquiry does not by itself establish an engagement or confirm a transaction’s suitability.
